1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In Short: We collect personal information that you provide to us such as name, address, contact information, passwords and security data, payment information, and social media login data.

We collect personal information that you voluntarily provide to us when registering at the Services expressing an interest in obtaining information about us or our products and services, when participating in activities on the Services (such as posting messages in our online forums or entering competitions, contests or giveaways) or otherwise contacting us.

The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make and the products and features you use. The personal information we collect can include the following:

Publicly Available Personal Information. We collect first name, maiden name, last name, and nickname; current and former address; email addresses; business email; business phone number; phone numbers; business entity filings, corporate affiliations, and business associates; and other similar data.

Credentials. We collect passwords, password hints, and similar security information used for authentication and account access.

Social Media Login Data. We provide you with the option to register using social media account details, like your Facebook, Twitter or other social media account. If you choose to register in this way, we will collect the Information described in the section called “HOW DO WE HANDLE YOUR SOCIAL LOGINS” below.

All personal information that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal information.

Information automatically collected

In Short: Some information — such as IP address and/or browser and device characteristics — is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

2. HOW DO WE USE YOUR INFORMATION?

In Short: We process your information for purposes based on legitimate business interests, the fulfillment of our contract with you, compliance with our legal obligations, and/or your consent.

We process your personal information for these purposes in reliance on our legitimate business interests, in order to enter into or perform a contract with you, with your consent, and/or for compliance with our legal obligations. We indicate the specific processing grounds we rely on next to each purpose listed below.

To send you marketing and promotional communications. We and/or our third party marketing partners may use the personal information you send to us for our marketing purposes, if this is in accordance with your marketing preferences. You can opt-out of our marketing emails at any time.

Deliver targeted advertising to you. We may use your information to develop and display content and advertising (and work with third parties who do so) tailored to your interests and/or location and to measure its effectiveness.

Request Feedback. We may use your information to request feedback and to contact you about your use of our Services.

To enable user-to-user communications. We may use your information in order to enable user-to-user communications with each user’s consent.

To manage user accounts. We may use your information for the purposes of managing our account and keeping it in working order.

To deliver services to the user. We may use your information to provide you with the requested service.

To respond to user inquiries/offer support to users. We may use your information to respond to your inquiries and solve any potential issues you might have with the use of our Services.

We may use your information for other Business Purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Services, products, marketing and your experience. Affiliates include our parent company and any subsidiaries, joint venture partners or other companies that we control or that are under common control with us.
  • Business Partners. We may share your information with our business partners to offer you certain products, services or promotions.

We may use cookies and similar tracking technologies (like web beacons and pixels) to access or store information. Specific information about how we use such technologies and how you can refuse certain cookies is set out in our Cookie Policy.

5. DO WE USE GOOGLE MAPS?

In Short: Yes, we use Google Maps for the purpose of providing better service.

This website, mobile application, or Facebook application uses Google Maps APIs. You may find the Google Maps APIs Terms of Service at https://developers.google.com/maps/terms. To better understand Google’s Privacy Policy, please refer to https://policies.google.com/privacy.

By using our Maps API Implementation, you agree to be bound by Google’s Terms of Service.

6. HOW DO WE HANDLE YOUR SOCIAL LOGINS?

In Short: If you choose to register or log in to our services using a social media account, we may have access to certain information about you.

Our Services offer you the ability to register and login using your third party social media account details (like your Facebook or Twitter logins). Where you choose to do this, we will receive certain profile information about you from your social media provider. The profile Information we receive may vary depending on the social media provider concerned, but will often include your name, e-mail address, friends list, profile picture as well as other information you choose to make public.

We will use the information we receive only for the purposes that are described in this privacy policy or that are otherwise made clear to you on the Services. Please note that we do not control, and are not responsible for, other uses of your personal information by your third party social media provider. We recommend that you review their privacy policy to understand how they collect, use and share your personal information, and how you can set your privacy preferences on their sites and apps.

7. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short:  We keep your information for as long as necessary to fulfill the purposes outlined in this privacy policy unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). No purpose in this policy will require us keeping your personal information for longer than the period of time in which users have an account with us.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

8. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. EB has entered into Data Protection Agreements with our vendors (subprocessors) to ensure that the privacy and security of our customer data is protected. We use others to help us provide our Services. They will have access to your information as reasonably necessary to perform these tasks on our behalf and are obligated to not disclose or use it for other purposes. Please also remember that we cannot guarantee that the internet itself is 100% secure. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the services within a secure environment.

9. DO WE COLLECT INFORMATION FROM MINORS?

In Short: >We do not knowingly collect data from or market to children under 18 years of age.

We do not knowingly solicit data from or market to children under 18 years of age. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. 10. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: You may review, change, or terminate your site account / subscription at any time.

We empower our users with certain rights to help assure the privacy and protection of their personal data. These rights include:

  • The right to be informed
  • The right of access
  • The right of rectification
  • The right to erasure / deletion
  • The right to restrict processing
  • The right to object
  • Rights on automated decision making/profiling

Account Information

If you would at any time like to review or change the information in your account or terminate your account, you can (1) Log into your account settings and update your user account; (2) Contact us using the contact information provided.

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with legal requirements.

Cookies and similar technologies: Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Services. To opt-out of interest-based advertising by advertisers on our Services visit http://www.aboutads.info/choices/ (read more about this in Section 14 on page 22).

Opting out of email marketing: You can unsubscribe from our marketing email list at any time by clicking on the unsubscribe link in the emails that we send through Constant Contact, a third-party service that further supports our compliance to global standards and regulations. Users also have the option of changing their subscription preferences through Constant Contact. You will then be removed from the marketing email list – however, we will still need to send you service-related emails that are necessary for the administration and use of your account. To otherwise opt-out, you may (1) Note your preferences when you register an account with the site; (2) Access your account settings and update preferences; (3) Contact us using the contact information provided.

11. OPTIONS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. This DNT option relies on a technology known as a DNT header that sends a signal to websites visited by the browser user about the user’s DNT preference. You can usually access your brower’s DNT option in your browser’s preferences; however, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy policy.

12. PRIVACY RIGHTS UNDER THE CALIFORNIA ONLINE PRIVACY PROTECTION ACT (CalOPPA)

In Short:  If you are a legal resident of California, you are granted specific rights under the CalOPPA.

California Online Privacy Protection Act Notice. To abide by the CalOPPA, this privacy policy includes the following information: (a) effective date listed in Section 14 on page 18; (b) the categories of personally identifiable information (PII) that we process and how that collected PII is shared is detailed in Section 14 (c) changes to the privacy policy on page 24; (d) how DNT requests are handled in Section 11; (e) how users can request to modify or delete their PII from our databases on page 24.

Shine The Light Law. California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below. If you are under 18 years of age, reside in California, and have a registered account with the Services, you have the right to request removal of unwanted data that you publicly post on the Services. To request removal of such data, please contact us using the contact information provided, and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Services, but please be aware that the data may not be completely or comprehensively removed from our and/or third-party systems, though we will document those requests to third-party service providers.

The Rights of Legal Citizens of California under the CalOPPA. As of January 1, 2020, CalOPPA gives legal residents of California the right to know what personal information is collected, with clear disclosure of the specific pieces of personal data collected, sold, or disclosed and to whom (see Section 14 for details) as well as the right to SAY NO to the sale of their personal information. These persons have the right to ‘say no’ to the sale of their personal information and the ability to have their contact information deleted. EP gives users the ability to ‘say no’ by providing a checkbox on the form-gated site pages. Requests for full deletion of contact information can be made through communications to privacy@empoweringpumps.com and through which confirmation of that deletion activity can be communicated. Persons exercising these rights will never be exposed to discrimination. If any concerns exist about your rights under the CalOPPA, please email privacy@empowering-brands.com.

California Consumer Privacy Act. Empowering Brands is not legally required to adhere to the California Consumer Privacy Act (CCPA), which went into effect on January 1st, 2020. This law is designed for social networks, data brokers and large corporations. Non-profits, individuals and small or medium-sized businesses do not have to comply. However, because Empowering Brands supports people’s rights to privacy, we provide the rights (1) to know what data is being collected; (2) to ‘say no’; (3) to deletion; and (4) to non-discrimination as outlined within the terms of this privacy policy.

13. PRIVACY RIGHTS AS THEY PERTAIN TO THE CANADIAN ANTI-SPAM LEGISLATION (CASL)

To help contacts understand what they’re opting into when submitting a form or pop-up form on our website, notice and consent information is provided to user. This allows us to capture a visitor’s consent to the processing of their personal information as well as their consent to receive communication from us. We manage permission-based lists through Constant Contact which is integrated using APIs into our website, and as such, their third-party system contains records of express and implied consent from our contacts. These records are documented and tracked within Constant Contact. If any methods other than the Constant Contact website sign-up form are used, such as a third-party sign-up form or manually uploaded list, CASL-compliance will be met by having the appropriate notice and consent information presented to users so contact’s express permission can be properly obtained and documented.

Our website (collectively, with any sub-domain of such website, the “Site”) is owned and operated by Empowering Pumps & Equipment (or referenced here by EP). By using materials and content on this Site or by clicking a box that states that you accept or agree to these Terms of Use, you signify your agreement to these Terms of Use. If you do not agree to these Terms of Use, you may not use the Site or any information (including information relating to any motor vehicle), materials, content, products, services or reports included on or otherwise made available to you through the Site.

Note that special terms may apply to some products or services offered on the Site, like purchased reports, subscription-based services, rules for particular contests or sweepstakes or other features or activities. These special terms shall be posted in connection with the applicable product or service. Any such special terms are in addition to these Terms of Use, and in the event of a conflict, prevail over these Terms of Use.

EP, it’s partners and its contractors own the Site and the Content and retain all intellectual property rights utilized in the Site and the Content. Neither the Site nor any Content may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of EP. You may not frame or utilize framing techniques to enclose any Trademark or other proprietary information (including images, text, page layout, or form) contained on the Site. Public Forum, Submissions and Submission License

The functionality of the Site may include chat areas, message boards, instant messaging, mobile messaging, conversation pages, e-mail functions (send-a-friend emails) and similar opportunities (each a “Public Forum”) for you to submit, provide or to otherwise make available, text, comments, messages, e-mails, photographs, videos and other content (“Submissions”) for display on a Site. Disclaimer of Warranties and Limitation of Liability

User Code

If you elect to purchase products on the Site, you may be given the opportunity to request a unique, non-transferable user code (your “User Code”) to identify you for the purpose of purchasing products on the Site. At the discretion of EP, approval and delivery of a User Code may be subject to completion of credit application by you, with subsequent approval by EP.

You agree to keep your User Code confidential, to prevent the use of your User Code by others, and to notify EP promptly of any identified unauthorized access or use of your User Code. YOU ARE SOLELY RESPONSIBLE FOR PAYMENT TO EP OF ANY FEES OR COSTS ARISING FROM ANY PRODUCTS PURCHASED THROUGH THE USE OF YOUR USER CODE, INCLUDING UNAUTHORIZED AND FRAUDULENT PURCHASES. You may not sell, resell, license, rent, lease, reproduce, duplicate, copy or otherwise exploit your User Code or distribute or provide access to any products available on the Site in a service bureau, out-sourcing, data processing or similar arrangement.

Payment of Fees

You agree to pay all applicable fees and costs for any products purchased by you or under your User Code, on or before the due date indicated on any invoice provided to you. You also responsible for the payment of any taxes arising from any purchased products. All fees and costs are final and will not be refunded in whole or in part. You agree that if any legal action is required to enforce EP’s right to payment of any fees, costs or any other amounts due for any purchased products, you will be responsible to pay all costs incurred by EP, including reasonable attorney’s fees, arising from any such action or any appeal thereof.

Indemnification

You agree to indemnify, defend and hold harmless EP and any of its directors, managers, officers, employees, agents, contractors and other representatives from all claims, demands, losses, expenses and costs whatsoever (including reasonable attorney’s fees) arising, directly or indirectly, out of your access, use, disclosure, publication, display or distribution of (a) the Site, (b) any of the Content or information (including any information contained in any Submission) you obtain from the Site, (c) any products you purchase or reports made available to you from the Site, (d) any Links or any Advertising, as well as any Submission you provide to the Site and any breach by you of these Terms of Use or related EP procedures.

Promotional Communications; Privacy Policy

You agree to receive from EP and its contractors, faxes or e-mail pertaining to the products and services offered on or through the Site or advertising that EP determines may be of interest to you. Termination

Notwithstanding any of these terms and conditions, EP reserves the right, without notice and in its sole discretion, to suspend or terminate your license and ability to access the Site (including, if applicable, your User Code), and to block or prevent you from future access to the Site, including any products or reports available through the Site.

Miscellaneous

These Terms of Use are governed by law, without regard to its conflicts of laws principles. If a court of competent jurisdiction finds that any provision in any section of these Terms of Use is illegal, unenforceable or invalid in any respect, then such provision will be ineffective to the extent of such finding without affecting the enforceability or validity of the section in which such provision is found, or any other section of these Terms of Use. Clear GIFS

We also employ a software technology called “clear gifs” (also known as “web beacons,” “pixel tags” or “web bugs”) that helps us better manage content on our Sites by providing us feedback as to what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of users.
